Apologies were received from Councillor Mrs E K Stokes.

Vice-Chairman

Minutes:

It was reported that Councillor Mrs E K Stokes had tendered her resignation as Vice-Chairman of the Committee for the time being.

 

It was agreed that Councillor L G Evans be appointed Vice-Chairman of the Committee until either Councillor Mrs E K Stokes returned as Vice-Chairman or the meeting of the Standards Committee in June 2010.

Exclusion of the Public and Press

To consider moving the following resolution:-

 

“That, under Section 100 I of the Local Government Act 1972, the public be excluded from the meeting because the following item of business involves the likely disclosure of exempt information as defined in Part 1 paragraph 7 of Schedule 12A to the Act, and it is in the public interest to deal with the matter in closed session”.

Alleged Breaches of Parish Council Code of Conduct

To consider the report of the Monitoring Officer together with the report and schedule provided by Mr Jon Mytton, Investigating Officer, regarding possible breaches of Parish Council Code of Conduct (reference WDC6.2009, WDC7.2009, WDC8.2009, WDC9.2009).

Minutes:

The Chairman welcomed Mr Jon Mytton, Investigating Officer to the meeting and thanked him for preparing such a thorough report.

 

The Committee had a full and detailed discussion regarding the report from the Investigating Officer for complaints WDC6.2009, WDC7.2009, WDC8.2009 and WDC9.2009.

 

The Committee sought clarification and asked questions where necessary of the Investigating Officer.

 

Having regard to the guidance on the circumstances in which the First-tier Tribunal would consider accepting a referral from a Standards Committee under regulation 17 of the Standards Committee (England) Regulations 2008, and considering that the action which the Committee could itself take if it were to find that the complaints did disclose breaches of the Code of Conduct would be insufficient, the Committee

 

Resolved (Unanimously)

 

(1)         That the First-tier Tribunal be requested to deal with this case.

 

(2)         That authority be delegated to the Monitoring Officer in consultation with the Chairman to deal with any matters which may arise in the future concerning this case.
