Minutes:
The Chair advised the Sub-Committee that as Merseyside Police had withdrawn their representations in connection with the above application as the applicant had negotiated with the objector and agreed revised hours, with that all parties had agreed that there was no longer a need for a hearing.
Exclusion of Press and Public
RESOLVED:
That, under Section 100A(4) of the Local Government Act, 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Paragraph 1, 2 and 7 of Part 1 of Schedule 12A to the Act. The Public Interest Test has been applied and favours exclusion of the information from the Press and Public.

That, under Section 100A(4) of the Local Government Act, 1972, the press and public be excluded from the meeting for the following item of business on the grounds that it involved the likely disclosure of exempt information as defined in paragraph 1 of Part 1 of Schedule 12A to the Act. Licensing Act, 2003 - Application for a Personal Licence - Mr. M.D.
Report of the Environmental Protection Director
Minutes:
The Sub-Committee considered the report of the Environmental Protection Director regarding an application by Mr. M.D. for the grant of a Personal Licence.
The Sub-Committee heard representations from:
(1)
Mr M.D, the applicant in support of the application;
(2)
Mr M.D Snr on behalf of the applicant in support of the application;
(3)
PC. S.Woods, on behalf of Merseyside Police objecting to the application.
All parties agreed the issues that were in contention and the procedure that was to be followed. There were no preliminary issues raised and at the end of the representations, everyone confirmed that they were satisfied they had said all they wished to say.
The Sub-Committee retired under Regulation 14(2) of the Licensing Act (Hearings) Regulations 2005 (as amended) and thereby continued to exclude the press and public whilst they reached their decision on the application. The Sub-Committee returned to give their decision with the press and public still excluded.
RESOLVED:
That the Application for the Grant of a Personal Licence in respect of Mr M.D be refused.
Reasons:
The Sub-Committee have heard representations from Constable Woods on behalf of Merseyside Police, the Applicant and his father, Mr.M.D,Snr, in support of the Application.
Whilst the Sub-Committee have listened carefully to the representations made on behalf of the Applicant, the Members have not heard any exceptional or compelling circumstances which would justify the granting of this licence.
