The meeting reconvened at 3.27pm THE COCOANUT, 16 MILL STREET, KINGSTON UPON THAMES, KT1 2RF The Sub Committee considered both written and oral representations from the police and oral representations from the applicant and RESOLVED that a counter notice should be given as it was necessary for the promotion of the crime prevention objective to do so. THE CRICKETERS, 20 FAIRFIELD SOUTH, KINGSTON UPON THAMES KT1 2UL The Sub Committee considered both written and oral representations from the police and oral representations from applicant and RESOLVED that a counter notice should be issued, as it was necessary for the promotion of the crime prevention objective to do so. The Sub Committee in making this decision had regard to evidence given by the police concerning the history of these premises; in particular that the current premises licence was suspended with a revocation order made by the Licensing Authority and not yet in force in respect of this licence and , given the allegations of fraud in connection with the premises licence holder, Mr Cherbel El Khoury, which are still being investigated, the incidents of drug use and underage drinking recorded at the premises and that Mr Cherbel El Khoury was still the leaseholder of the premises and would surely gain financially from this temporary event notice proceeding. The Sub Committee believed the crime and disorder licensing objective would not be met if this event proceeded. Note. This item was considered as an urgent item on the grounds that this temporary event would have been for the period 25-28 December and the hearing needed to be before 24 December, which posed difficulties in scheduling a separate hearing. Both the applicant and the police agreed also to waive the period for notice of notification of this hearing which is set out in Regulation 6(1) and 6(2) of the Licensing Act 2003 (Hearings) Regulation 2005. </div> </div> <div class="mgHelpLine"> </div> </div> 2009-12-07T16:04:39+00:00

The Sub Committee believed the crime and disorder licensing objective would not be met if this event proceeded.   Note.  This item was considered as an urgent item on the grounds that this temporary event would have been for the period 25-28 December and the hearing needed to be before 24 December, which posed difficulties in scheduling a separate hearing. Both the applicant and the police agreed also to waive the period for notice of notification of this hearing which is set out in Regulation 6(1) and 6(2) of the Licensing Act 2003 (Hearings) Regulation 2005. </div> </div> </td> </tr> </table> <div class="mgHelpLine"> </div> </div>
