The Sub-Committee considered the report of the Environmental Protection Director in respect of representations made by the Premises Licence Holder of the above named premises against the interim steps taken under Section 53A of the Licensing Act 2003, by the Licensing Sub-Committee on 30 July 2009. (Minute No. 14), which had entailed the immediate suspension of the Premises Licence.

 

All parties agreed the issues that were in contention and the procedure that was to be followed.

 

The Sub-Committee heard representations from Mr. A. Horne, Solicitor, on behalf of the Premises Licence Holder and from Sergeant N. Cowell, on behalf of Chief Superintendent Pilling, Merseyside Police.

 

Mr. Horne called Mr. David Rivett, the Designated Premises Supervisor and Premises Licence Holder as a witness.

 

The Sub-Committee questioned Mr. Horne and Sergeant Cowell on their representations and at the end of the representations everyone confirmed that they were satisfied that they had said all they wished to say.

 

Under Regulation 14(2) of the Licensing Act (Hearings) Regulations 2005 (as amended) the Sub-Committee excluded the press and public from the meeting whilst they reached their decision on the application and recalled the press and public for the decision to be read out in full.

 

RESOLVED:

 

That the suspension imposed as part of the interim steps is lifted with immediate effect and the conditions agreed by the Police also come into immediate effect.

 

The Sub-Committee have heard representations from Mr. Horne on behalf of the Premises Licence Holder and the response from Sergeant Cowell on behalf of Merseyside Police.

 

The Sub-Committee is satisfied that the Premises Licence Holder has fully co-operated with the Police and has made commendable progress in the short time since the interim steps hearing.

 

Agreement has been reached with the Police as to the conditions to be imposed on the licence to ensure compliance with the licensing objectives.

 

This matter will be subject to a formal Summary Review on 13 August 2009, when any additional representations will be considered and the whole issue will be finalised.
